# Terms of Service

> **Draft — not yet reviewed by counsel.** Published for review; not in effect.

**Effective date:**

These are the terms for using Streamliner. We have tried to make them readable, and to be direct about the things that matter most: what Streamliner is, how much of it is in your hands, and how little of what happens through it we can see or answer for.

**Please read sections 6 through 9 and 17 through 22 closely.** They explain the third-party streamlines, servers and AI models Streamliner connects you to, your responsibility for checking them, the limits on what the assistant's answers are worth, and the limits of our liability. **Section 20 contains an agreement to resolve disputes by individual arbitration and a waiver of class actions, with a way to opt out.**

## 1. Who these terms are with, and how you agree

Streamliner is published by **Manolab, LLC**, [a STATE limited liability company] ("Manolab", "we", "us"). These terms are an agreement between Manolab and you, and they cover:

- the **Streamliner app** for iPhone, iPad and Mac (the "App");
- the **hosted service** we run for organization accounts, including sign-in, the model relay, configuration hosting, the chat record, file uploads, usage and links shared through Discover (the "Hosted Service");
- the website at **streamliner.work** (the "Site");

together, "Streamliner".

**How you agree.** You accept these terms, our [Acceptable Use Policy](/terms/acceptable-use) and, if you share a streamline with others, our [Publisher Terms](/terms/publishers) by tapping or clicking to agree when the App or the Site asks you to, or by signing an agreement with us that includes them. Our [Privacy Policy](/privacy) explains how we handle personal information. If you don't agree, don't use Streamliner. [Counsel: the App does not yet ask anyone to agree; see the attorney brief, §6, finding 1. Until it does, these terms bind only people and organizations that have agreed in writing.]

**If you use Streamliner for an organization.** If you accept these terms for a company or other organization (for example, by creating or administering an organization account), you confirm you have authority to bind it, and "you" includes that organization. An organization may also sign a separate agreement with us (an order form, master agreement or data processing agreement). **If it does, that agreement controls** where it conflicts with these terms, for that organization.

**If you are a member of an organization**, your organization has its own agreement with us, and its own rules for you, which may be stricter than these. These terms still apply to your own use.

## 2. The short version

This summary helps you find your way; the full sections below are the terms.

- Streamliner is **a client and a relay**: an app that lets an assistant use the tools you are given, and a hosted service that carries an organization's setup and its assistant's requests. **It isn't the systems it connects to, and it isn't the AI.**
- **You decide** what you type, attach, dictate and scan, which streamlines you use, which servers you connect, and what you confirm. In an organization, **the organization decides** almost everything else.
- **We can't see or vouch for** the servers a streamline connects to, streamlines made by other people, what an AI provider does with what it receives, or what you choose to give an assistant. **Checking those is your responsibility** (or your organization's).
- **The assistant can be wrong.** Check its work before you rely on it, and before you confirm anything.
- Streamliner is provided **as is**, and **our liability is limited** to the greater of what you paid us in the past 12 months or US$100, except where the law doesn't allow a limit.

## 3. What Streamliner is, and what it isn't

**What it is.** Streamliner turns a piece of business work into a conversation. Each department of an organization (or each person, on their own device) has a **streamline**: a preset assistant with instructions, a set of tools and an AI model. Each **chat** in a streamline is one job. The assistant does the work by calling tools on servers (often called **MCP servers**) and APIs that belong to the organization or to others, **acting as the signed-in person**, with that person's own sign-in (or none, where a server needs none).

**What it isn't.**

- **It isn't the systems it connects to.** Your organization's systems, and the third-party servers a streamline uses, are run by their owners, who decide what is allowed and what happens to the data they receive. Streamliner passes requests to them and shows you their answers.
- **It isn't an AI provider.** The assistant is a model run by an AI provider (Anthropic today) under your own agreement with that provider, or your organization's. We don't make or control the model, and we don't train models.
- **It isn't a professional adviser**, and its answers aren't legal, financial, tax, medical, employment or other professional advice.
- **It isn't a system of record or a compliance tool.** An organization's chat record is kept for the time it sets; whether that record meets a law or regulation that applies to the organization is the organization's responsibility.
- **It isn't a security product.** Its safeguards (section 8) help people avoid mistakes. The systems the assistant calls are what actually decide what may be done.

## 4. Who may use Streamliner

You must be **at least 18 years old** (or the age of majority where you live, if higher) and able to form a binding contract. Streamliner isn't for children. You may not use Streamliner if you are barred from doing so under the laws that apply to you, including the sanctions and export laws in section 24.

## 5. The two ways to use Streamliner

### On this device (free)

You can use Streamliner on your own, with no account. You are, in effect, your own organization:

- you make or import your own streamlines and decide their instructions, tools, servers and model;
- you supply **your own AI provider key**, and the assistant's requests go **straight from your device to the provider, under your own agreement with that provider**, which governs that use and its cost;
- you choose and sign in to the servers your streamlines use;
- your streamlines, keys and chats stay on your devices and, if you turn on sync, your own iCloud.

We don't host any of your work. **You are responsible for your setup**, for your agreement with the AI provider and the costs it charges, and for complying with the terms of every server you connect.

### Organization accounts (hosted)

An organization account is set up for an organization, which uses it under its own agreement with us. In an organization account:

- **Owners** manage the account and its people, its brand and sign-in, account-wide limits and networks, and approve which devices may publish changes. **Admins** manage its streamlines (including each one's limits and network rule), invite and manage members, and can set the AI provider key. **Members** use the streamlines their roles allow.
- **The organization configures; you converse.** The organization chooses each streamline's instructions, tools, servers, model and limits. As a member you don't change them.
- **The organization brings its own AI provider key**, and requests go to the provider through our relay **under the organization's agreement with the provider**. (When an owner or admin uses the Concierge to change the organization's setup, the Concierge uses that person's own key instead; see the [Privacy Policy](/privacy).)
- **The organization keeps a record of its chats**, which its owners and admins can read, including each person's, and decides how long it is kept.
- **The organization can change your access at any time**: change your roles, suspend you, sign you out of your devices or remove you. When your access ends, the App removes the organization's chats, sign-ins and setup from your device.
- **Disputes between you and your organization**, including about your access, your chats or your employment, are between you and it.

**If you administer an organization account**, you are responsible for:

- who you invite and what access you give them;
- the streamlines, instructions, tools and servers you configure;
- the AI provider and model you choose, and your agreement with that provider;
- the limits, networks and retention you set;
- **telling your people, before they use Streamliner, that your owners and admins can read the chats in your organization's account**, and getting any acknowledgment the law requires for electronic monitoring;
- telling your people that the assistant's output can be wrong and needs checking;
- **if you offer a streamline to people outside your organization** (such as your customers), telling them before they start that the chat is with an AI assistant, that it is recorded, and who processes it, and getting any consent the law requires, including consent to recording from every party where the law calls for it;
- telling anyone whose data passes through your streamlines what the law requires you to tell them, and getting any consent it requires;
- keeping the account's keys and owner devices safe.

## 6. Third-party streamlines, servers and models

This is the heart of these terms. Streamliner is a way to reach things that **other people make and run**. We can't know which streamlines you get or from whom, which servers they connect to, or what you choose to give the assistant through them, and we don't check.

### Streamlines from others

You can import a streamline from a file, or open one from a link someone shares (including, when we offer it, from Discover). A streamline decides **which servers your chats reach** and **which instructions the assistant follows**. A streamline from someone else may send what you type, and what its tools return, to places that someone chose. It may be badly made, out of date or deliberately misleading, and its instructions may try to make the assistant do things you didn't intend.

For a streamline shared by link, Streamliner shows who shared it, checks that it hasn't been altered since its publisher signed it, and shows what it connects to before you get it. **That is all.** A file you import is added as it is, with no check. A publisher's name tells you who shared a streamline, not that it is safe, accurate or fit for your purpose. We don't review, test, endorse or monitor streamlines others publish. Streamlines from Streamliner's own channel are made by us, but the servers they connect to belong to others, and this section's terms about servers apply to them in full.

### Servers and APIs

The tools a streamline uses run on servers and APIs that belong to your organization or to third parties. They receive the data the tools need, apply their own rules and policies, keep their own records, and may be changed, broken or taken down at any time. **They are not ours, we don't operate or monitor them, and we aren't responsible for them**, for what they do with your data, or for the results of what they do.

A server's answers are data from a stranger: they can be wrong, incomplete, or written to mislead the assistant. Streamliner draws server results with its own fixed templates and doesn't run code from them, but it can't tell you whether what a server says is true.

### AI models and providers

The assistant is an AI model run by a provider under **your own agreement with that provider** (on this device, and when you use the Concierge) or **your organization's** (in an organization account). That agreement, including the provider's usage policies, governs what may be sent to the model, what the provider does with it, and what it costs. **We aren't a party to it, and we aren't responsible for the provider's service, its availability, its handling of data, or its output.**

### Other third-party services

Streamliner works with services from Apple (the App Store, iCloud, Sign in with Apple, on-device speech recognition), web pages a streamline links you to (such as a payment page), and the sign-in pages of the systems you use. Their terms govern your use of them.

**Your use of any third-party streamline, server, model or service is at your own risk and under its own terms.** To the fullest extent the law allows, and subject to section 18, Manolab has no liability for them.

## 7. Your responsibilities, and your due diligence

You are responsible for:

- **What you give the assistant**: what you type, paste, attach, dictate and scan, and the tools you let it use. Don't give it anything you aren't allowed to share with the AI provider and the servers involved.
- **Checking before you connect.** Before using a streamline from someone else, or connecting a server, find out who made and runs it, what it will receive, where that data goes, and what its terms and privacy policy say. If you use Streamliner for an organization, follow its rules about which services may receive its data.
- **Using secure forms for secrets.** Card numbers, ID numbers, passwords and similar values belong in the secure forms a streamline provides, never in the chat. The App warns you when something you type looks like a card or Social Security number, but it can't recognize passwords or most other secrets.
- **Reviewing before you confirm**, and the actions you confirm (section 8).
- **Your devices and sign-ins**: keeping your devices locked and up to date and your keys and sign-ins private, and telling your organization (or us) if you think someone else has used them.
- **Following the law** and the terms of every service you reach through Streamliner, including the AI provider's usage policies and our [Acceptable Use Policy](/terms/acceptable-use).
- **Your own backups.** Chats on your device are deleted on the schedule you or your organization set, and when you leave an organization. Keep copies of anything you need elsewhere.

## 8. AI output, confirmations and Streamliner's safeguards

**The assistant can be wrong.** AI output can be inaccurate, incomplete, out of date, or confidently untrue. It can misread what you wrote or what a tool returned, and it can be misled by instructions hidden in a server's answers or in a streamline. **Don't rely on it as your only source of truth, and check what matters before you act on it.** It isn't professional advice. Its output may also be similar to output given to others.

**Confirmations.** Streamliner holds the steps a streamline marks as irreversible (those that move money, complete a transaction or can't be undone) until you tap to confirm on a card showing the real data. The card is a safeguard, designed to hold every step the streamline marks. **When you confirm, you are the one taking the action**, and you are responsible for it. Not every consequential step is marked: whether a step is marked is up to whoever made the streamline. On your own device, you decide which tools ask first. **If you let a tool run without asking, you are responsible for what it does.** Review each card before you tap it.

**The Concierge**, the built-in assistant that helps you set things up, proposes changes. Nothing it proposes is saved until you approve it, and you are responsible for the changes you approve and publish.

**Secure forms and warnings** keep secrets out of the conversation when they are used as designed. They depend on the streamline and its servers offering them, and on you using them.

**What actually decides what may be done** is the system the assistant calls, acting on your own sign-in and permissions. Streamliner's own checks (confirmation cards, tool lists, network limits, daily limits) are real, but they are a second line: they can't make an unsafe action safe, and we don't promise they will stop every mistake or misuse.

**Automated decisions.** Don't use Streamliner to make decisions with legal or similarly significant effects on people (such as on employment, credit, housing, insurance, education or access to essential services) without meaningful human review, and only where the law allows.

## 9. Acceptable use

You must follow our [Acceptable Use Policy](/terms/acceptable-use), which is part of these terms, and the usage policies of the AI provider your streamline uses. We may cooperate with an AI provider that tells us a key or an account is being used against its policies.

## 10. Your content

**What's yours stays yours.** "Your content" means what you or your organization put into Streamliner (messages, files, streamlines, configuration) and what the assistant produces for you. As between you and Manolab, **you (or your organization) own your content**, to the extent the law allows anyone to own it. To the extent we have any rights in output produced for you, we assign them to you. We don't claim ownership of your content and don't promise that anyone can own AI output.

**What you let us do with it.** You give Manolab a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, process and display your content **only as needed to run, secure and support Streamliner for you**, to follow your or your organization's instructions, and to comply with the law. For free use on your own device, we receive none of your content, so this license applies only to what you choose to send us (such as an issue report).

**We don't train AI models on your content**, we don't give it to anyone to train theirs, and we don't sell it. If we ever wanted to change this, we would ask first, and the change would apply only to content sent after you (or your organization) agreed.

**You promise** that you have the rights and permissions needed to put your content into Streamliner and to send it to the AI provider and servers your streamlines use, and that doing so doesn't violate the law or anyone's rights.

**The AI provider's terms** govern its rights in what is sent to it, and whether you own output under its terms.

## 11. Sharing streamlines, and Discover

If you share a streamline by link (today, something an organization's owners and admins do for it), our [Publisher Terms](/terms/publishers) apply. A streamline shared by link is visible to anyone who has the link. You can stop sharing a link, but copies people already saved remain with them.

## 12. Feedback

If you send us ideas or suggestions (for example through Report an Issue), we may use them without owing you anything. Don't send us anything you consider confidential.

## 13. Fees, AI provider charges and the App Store

**Free use.** Using Streamliner on your own device is free.

**AI provider charges.** You (or your organization) are responsible for every charge your AI provider bills to your key, including charges for requests Streamliner makes on your behalf, retries, and long or repeated work a streamline's instructions cause. Daily limits and budgets are tools to help you, not a guarantee that charges will stay under them.

**Organization accounts** are provided under the organization's agreement with us, which sets any fees. If we offer plans in the App, their prices are shown before purchase. A plan buys hosting and capacity, **not AI usage**: the organization pays its AI provider directly, through its own key.

**In-app subscriptions**, if we offer them, are sold by Apple and governed by Apple's terms. They renew automatically for the same period unless canceled at least 24 hours before the end of the current period, and your Apple ID is charged within 24 hours before the period ends. Manage or cancel them in your Apple ID's subscription settings. **Refunds for App Store purchases are handled by Apple** at [reportaproblem.apple.com](https://reportaproblem.apple.com); we can't issue them ourselves.

**When an organization's agreement or subscription ends**, its account may become read-only for a grace period, after which its hosted data is deleted, as its agreement with us and the [Privacy Policy](/privacy) describe. Owners are responsible for exporting anything they need before then.

**Taxes.** Prices don't include taxes unless stated; you are responsible for taxes on what you buy, except taxes on our income.

**Price changes.** We may change prices for future periods. We will tell you in advance, and you can cancel before the new price applies.

## 14. Our rights in Streamliner

Streamliner, including the App, the Hosted Service, the Site, their software, design and documentation, and the Streamliner name and logo, belongs to Manolab and its licensors and is protected by law. Subject to these terms, we grant you a personal, revocable, non-exclusive, non-transferable license to install and use the App on Apple devices you own or control, and to use the Hosted Service and the Site, for your own purposes or your organization's. If you got the App from the App Store, section 23 also applies. You may not copy, modify, reverse engineer (except as the law allows despite this limit), resell or redistribute Streamliner, or use our name or logo in a way that suggests we endorse you, without our written permission.

Example organizations and data in the App and on the Site (such as **Meridian Jewelers**) are fictional.

## 15. Availability, changes and early versions

We work to keep Streamliner running well, but it may be interrupted, slowed or unavailable, including for maintenance, and things outside our control (Apple, Cloudflare, AI providers, your organization's systems, networks) can stop it working. We may change, add or remove features. If we remove a material feature an organization pays for, we will tell it in advance where we reasonably can.

**Early versions** (such as TestFlight builds, and features we call preview, beta or early access) may be unfinished, may change or disappear, and are provided with no commitments of any kind.

The **Meridian demo** is a scripted, offline demonstration with fictional data, for trying the App. It sends nothing anywhere and performs no real transactions.

## 16. Suspension and ending

**You can stop at any time.** Remove *On this device* from your accounts, leave an organization, or delete the App. An organization's owners can end its account under its agreement with us.

**We may suspend or end your access** to the Hosted Service (or an organization's account), or remove a shared streamline, if we reasonably believe you have broken these terms or the Acceptable Use Policy, if it is needed to protect people, the service or others' data, if the law requires it, or if an organization's agreement has ended. Where reasonable and lawful, we will tell you first and give you a chance to fix the problem. We may also discontinue Streamliner or the Hosted Service entirely with reasonable notice; if we do, we will refund any prepaid fees for the period after it ends (App Store purchases through Apple's process).

**What survives.** Sections 6 to 8, 10, 12, 14 and 17 to 26, and anything else that by its nature should, survive the end of these terms.

## 17. Disclaimers

**To the fullest extent the law allows, Streamliner is provided "as is" and "as available", with all faults and without warranties of any kind**, express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy and quiet enjoyment, and any warranties arising from a course of dealing or usage of trade.

Without limiting that, **we don't warrant** that Streamliner will be uninterrupted, secure or error-free; that any AI output, tool result or streamline will be accurate, complete, lawful or suitable; that data won't be lost; or that any third-party streamline, server, model or service will work, be safe, or protect your data.

Some places don't allow some of these disclaimers, so some may not apply to you; section 21 says more for consumers outside the United States. Where a warranty can't be excluded, it is limited to the shortest period the law allows. If you live in New Jersey, nothing in sections 17 to 19 limits any right you have under New Jersey law that can't be limited.

## 18. Limitation of liability

**To the fullest extent the law allows:**

- **Manolab won't be liable for any indirect, incidental, special, consequential, exemplary or punitive damages**, or for any loss of profits, revenue, business, goodwill or data, or the cost of substitute services, arising from or related to Streamliner or these terms, however caused and on any theory of liability (contract, tort including negligence, or otherwise), even if we were told they were possible.
- **Manolab won't be liable for** losses caused by third-party streamlines, servers, APIs, models, providers or services; by the content of AI output, or by actions you or your organization choose to take on it; by your organization's configuration or decisions; or by unauthorized access to your devices or sign-ins that we didn't cause, **except to the extent the loss was caused by our breach of these terms or by a defect in Streamliner's own software** (for example, a confirmation card that shows data different from what the system then receives).
- **Manolab's total liability** for all claims arising from or related to Streamliner or these terms is limited to **the greater of (a) the amounts you paid Manolab for Streamliner in the 12 months before the event giving rise to the claim, and (b) US$100.** For an organization with a separate agreement with us, the limit in that agreement applies instead.

These limits apply even if a remedy fails of its essential purpose, and they reflect how we price Streamliner and offer its free use.

**Nothing in these terms excludes or limits** liability for fraud or fraudulent misrepresentation, gross negligence, willful misconduct, death or personal injury caused by negligence, violation of law where the law doesn't allow the limit, or any liability or right that can't be excluded or limited under the law that applies to you, including statutory damages under privacy laws.

## 19. Indemnity

**Organizations.** An organization that uses Streamliner (through an organization account, or otherwise for its business) will defend, indemnify and hold harmless Manolab and its members, officers, employees and agents from and against any third-party claims, and the resulting losses, liabilities, damages and costs (including reasonable attorneys' fees), arising from: its content and its people's use of Streamliner; the streamlines it configures or shares and the servers they connect to; its use of Streamliner in breach of these terms, the Acceptable Use Policy or the law; or its violation of anyone's rights.

**Individuals.** If you use Streamliner as a member of an organization, the organization, not you, gives this indemnity. If you use Streamliner on your own and not for a business, you give it only for claims arising from your intentional misuse of Streamliner or your violation of law, and only to the extent the law where you live allows.

We will tell the indemnifying party promptly of any claim, let it control the defense (though we may join with our own counsel at our own cost), and cooperate reasonably. It won't settle a claim that admits fault for us or binds us without our consent.

## 20. Resolving disputes

[Counsel: this section offers arbitration and a class-action waiver as an option, following the major AI providers' consumer terms. It is enforceable only against people who agreed to these terms (section 1). If Manolab prefers courts only, replace 20.2 to 20.6 with 20.7 alone.]

### 20.1 Talk to us first

Most problems can be solved by talking. Before bringing a claim, you agree to send us a written notice describing it and the relief you want, at the contact details in section 26. We will send our notices to the email or postal address you give us, or, if you haven't given us one, to the address in your notice. We each agree to try in good faith to resolve the dispute informally for **60 days** after the notice is received. The time limit for bringing a claim is paused during this period.

### 20.2 Arbitration

**If we can't resolve a dispute informally, you and Manolab agree to resolve any dispute, claim or controversy arising from or related to Streamliner or these terms by final and binding individual arbitration**, except as 20.4 provides. The arbitration will be administered by [JAMS / the American Arbitration Association / National Arbitration and Mediation] under its consumer rules then in effect, before a single arbitrator. The arbitrator decides all questions, including whether a dispute must be arbitrated, **except that a court decides disputes about 20.3 (no class actions), 20.6 (many similar claims) and the enforceability of this section as a whole.** The Federal Arbitration Act governs this section. Hearings may be held by video or, for claims under US$25,000, on written submissions, unless the arbitrator decides otherwise; any in-person hearing will be in your county of residence or another place we agree. We will pay all fees the [provider]'s consumer rules assign to the business, and your filing fee beyond US$[x], unless the arbitrator finds your claim frivolous.

**Organizations with a signed agreement** with us resolve disputes as that agreement provides, and this section doesn't apply to them.

### 20.3 No class actions

**You and Manolab may bring claims against each other only individually, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding.** The arbitrator may not consolidate claims of more than one person or award relief on behalf of anyone but the individual party, except as 20.6 provides.

**Nothing in this section waives your right to seek public injunctive relief in any forum.** A claim for public injunctive relief will be stayed and decided by a court only after the arbitration of all individual claims. If this class waiver is found unenforceable for a claim, that claim (and only that claim) must be brought in court under 20.7, after the individual arbitration of every other claim.

### 20.4 Exceptions

Either of us may bring an individual claim in **small claims court** if it qualifies, and either of us may ask a court for an injunction to stop infringement or misuse of intellectual property, or unauthorized access to the service.

### 20.5 Opting out

**You can opt out of this agreement to arbitrate within 30 days** of first accepting these terms (or, if this section changes materially, of the change) by sending us a notice at the contact details in section 26 with your name, the email address you use with Streamliner (if any), and a clear statement that you opt out of arbitration. Opting out doesn't affect the rest of these terms.

### 20.6 Many similar claims

If 25 or more similar claims are filed by or against Manolab within 90 days of each other, by or with the help of the same or coordinated counsel, they will be administered in batches of up to 50 claimants, with one arbitrator, one set of fees and one hearing per batch, and the parties will cooperate to resolve them efficiently. **Every claimant's limitation period is paused from the filing of the first batch until their own batch is heard.** A court decides disputes about this paragraph.

### 20.7 Governing law and courts

These terms are governed by the laws of the **State of [California]**, without regard to its conflict-of-law rules, and by the Federal Arbitration Act for section 20. Any claim not subject to arbitration will be brought only in the state or federal courts located in **[Santa Barbara County, California]**, and you and Manolab consent to their jurisdiction. Section 21 adds to this for consumers outside the United States.

## 21. Consumers in the EU, the UK and other countries with mandatory consumer law

If you are a consumer living in the European Union, the United Kingdom or another country whose law gives consumers protections a contract can't remove:

- you keep the protection of the mandatory provisions of the law of the country where you live, even though these terms choose California law, and you may bring claims in your local courts; sections 20.2 to 20.7 don't take that away;
- sections 17 and 18 apply only as far as that law allows. In particular, we are responsible under the statutory rules for the conformity of digital content and services where they apply, and for loss that was reasonably foreseeable and caused by our breach of these terms;
- we will change these terms only for a valid reason (a change in the law or in the service, or to address misuse), and you can stop using Streamliner before a change applies.

## 22. Changes to these terms

We may change these terms. We will post the new version here with a new effective date and keep earlier versions [published on this site]. If a change is material, we will tell you in advance, in the App or by email to organization owners, at least 30 days ahead where we reasonably can. Changes required by law, or that only add new features and don't reduce your rights, may take effect sooner. If you don't agree to a change, stop using Streamliner (organizations may end their accounts under their agreements). We will ask you to agree to material changes the way section 1 describes.

Two kinds of change never apply backward:

- **a change to section 20 won't apply to any claim that arose before the change;**
- **a change that would let us train AI models on your content, or use it in a way the Privacy Policy's *What we don't do* rules out,** applies only to content sent after you (or your organization) agreed to it.

## 23. If you got the App from Apple's App Store

These terms apply between you and Manolab only, **not Apple**, and **Manolab, not Apple, is solely responsible for the App** and its content. Your use of the App must also follow the Usage Rules in Apple's Media Services Terms and Conditions. Your license under section 14 is a non-transferable license to use the App on Apple-branded products you own or control, as those rules permit, except that the App may also be accessed, acquired and used by other accounts associated with the purchaser through Family Sharing, volume purchasing or Legacy Contacts. Family Sharing members must also meet section 4.

- **Maintenance and support.** Manolab, not Apple, is responsible for any maintenance and support of the App. Apple has no obligation to provide any.
- **Warranty.** To the extent any warranty isn't effectively disclaimed, Manolab is responsible for it. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the fullest extent the law allows, Apple has no other warranty obligation for the App, and any other claims, losses, liabilities, damages, costs or expenses from any failure to conform to a warranty are Manolab's responsibility, subject to these terms.
- **Product claims.** Manolab, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws, including in connection with the App's use of the HealthKit and HomeKit frameworks (which it doesn't use).
- **Intellectual property.** If a third party claims the App or your possession or use of it infringes their intellectual property rights, Manolab, not Apple, is solely responsible for investigating, defending, settling and discharging the claim.
- **Legal compliance.** You represent and warrant that you are not located in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
- **Developer name and address.** Questions, complaints or claims about the App go to Manolab, LLC, [postal address], telephone [phone number], email [contact email].
- **Third-party terms.** You must comply with the terms of any third-party service you use with the App, such as your wireless data provider, AI provider and the servers your streamlines connect to.
- **Third-party beneficiary.** Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them, Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

## 24. Export controls and sanctions

Streamliner is subject to US export control and sanctions laws. You may not use, export or re-export it in violation of them, including to a country or region under comprehensive US sanctions, or for anyone on a US restricted-party list.

## 25. General terms

- **Entire agreement.** These terms (with the policies they refer to, and any separate agreement an organization signs with us) are the whole agreement between you and Manolab about Streamliner.
- **Assignment.** You may not transfer these terms without our written consent. We may transfer them in a merger, acquisition or sale of assets, or to an affiliate; we will tell you before the transfer, and the new owner will be bound by them.
- **Severability and waiver.** If part of these terms is unenforceable, the rest stays in effect and that part is enforced as far as possible. Not enforcing a term isn't a waiver of it.
- **Equitable relief.** A breach of the security terms of the Acceptable Use Policy may cause harm that money can't fix, so we may ask a court to stop it.
- **No third-party beneficiaries.** Apart from Apple (section 23), nobody else, including an organization's customers, has rights under these terms.
- **Force majeure.** We aren't responsible for delays or failures caused by events beyond our reasonable control.
- **Independent parties.** Nothing here creates a partnership, employment or agency relationship.
- **Electronic notices.** You agree to receive notices electronically, in the App, on the Site or by email, and that they satisfy any writing requirement.
- **Government users.** The App and its documentation are "commercial items" and "commercial computer software", licensed to US government users only with the rights given here.
- **California users.** Under California Civil Code section 1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210.
